I want to wish everyone taking the California bar exam today the very best of luck! Remember, that any topic can repeat from the last bar round. Also, be aware that any subject that is tested on the morning essays could repeat in some way on the afternoon essays – especially professional responsibility or remedies.
Remedies comes up so frequently – either as a full remedies essay or as a crossover with another topic. Often the bar examiners have tested just equitable lien and constructive trust as short, tack on issues to another essay topic. These are perhaps two of the most tested concepts on the California bar exam because it is a common remedy and helps to explain what the plaintiff might be able to do in order to recover. It can come up in community property and virtually any subject area.
My best advice for you today is to write you heart out today, do not leave anything on the table and do not have doubts or fear about it. They are only going to grade what you write, what is on the page. So if you do not put it in your exam, the graders have no idea that you thought about it. Bringing up an issue that you thought might be there and quickly dismissing it, is a very good way to inform the grader of what you are thinking.
